Posted - 11 December 2009 : 22:41:22 Bit of background info. Wife and I declared bankrupt on October 7th, had our interview with the OR which went fairly well, provided all information asked by OR. We surrendered our house to NR who have already taken possession of the house. We haven't be given an ipa as my wife has given up work as we had to move closer to my work. (I used to drive 500 miles a week just to get to work)
My question is now my or/assistant said that due to I&E I won't have an ipa but have signed up for a nil tax code. Will the or request further Bank statements from me to see what/ how we are spending our money.
Reason I ask is that I have a car on HP that the or's assistant said I couldn't keep in one breath and in the next said that if I could find the money within my Di and food bill I could keep the car depending on what the finance company says.
We have been struggling for so long that we have been used to living on the bear minimum, probably like most if you have before br.

Posted - 12 December 2009 : 09:45:23 The OR shouldn't request further bank statements however they have complete control over your finances until you are discharged so it is possible.
What can happen is if the OR applies for early discharge you will need to complete another I&E. Normally you just complete the form and that's it but the OR could request bank statements.
You should hear about the car within the next couple of weeks. Once you have had your interview the OR's Assistant writes up a report and this goes to their supervisor for the final say on the I&E, whether the car can be kept, etc. If you can keep the car they will send out a letter confirming that it is exempt from the BR.

All seem to have gone too smoothly so far, I know everybodys case is different and ours is fairly straight forward but I still need a car to get to work and don't want to give it up.
