Hi
I was wondering what the spending limits are on the bankruptcy application for just a couple. I don't know if I may be putting to high figures even though it is correct. Also do they look into your credit history. e.g experian.

Just to add on to Skippy's post - Don't take too much notice of the 'guidance' figures for utility bills; You should put down what the bills actually are.

If the OR disagrees with the figures then you can forward the bills and they have no option but to agree with them. The OR cannot force you to change utility companies if they believe that you could spend less with a different company.

the OR has the ability to check your financial status bank accounts and asset sales through your near and distant past should he feel the need to do so..
it is advisable to be completely honest with the OR and your SOA statement of affairs is a legal document you sign under oath should you lie about its contents you can be guilty of Perjery

Hi There,

The OR as access to Experian Citizen View, where he can undertake a full credit check going back 6 years.
He may or may not undertake this search depending on what you inform him of, and if this info is corroborated by your bank statements i.e. If you declare 3 credit accounts, but your bank statements shore direct debits to 4 creditors this will get the alarm bells ringing and the OR will dig deep - very deep.

The guideline figures are available at www.insolvency.gov.uk/DocumentLibrary/Policy/Excel/Household%20Expenditur.xls

There shouldn't be any reason for the OR to look into your credit history unless they think that you haven't been completely honest during the interview and you have other debts that you are hiding. If this is the case then they would investigate further and could check your credit history to see exactly which debts you have.
