Posted - 12 December 2009 : 16:21:55 hi all, back again. i am still really worried about being in overdraft when e declare bankruptcy. Our iva is being terminated but during ive there was still an overdraft attached to our account. despite asking for it to be taken off. we are into our £2000 overdraft by about £500. it will definately not go any further than that. really worried that will will be refused bankruptcy. hoping to book appointment at court for end of febrauru begin of march. also does anyone know if you can get a savings account when bankrupt. we have just opened a co op cashminder account but they refused us a savinhgs account because of credit history. seems daft that we can get a bank account but not a savings account. thank you x |

Posted - 12 December 2009 : 23:35:37 it would be highly unlikely that you would receive a BRU for using your overdraft before BR. the OR is well aware that you have to live and find the court fees from somewhere at the end of the day £500 is neither here nor there it doesn't even cover all the court fees i wouldn't worry at all

Everyone can see that you have done your best to make the IVA work, and even if you do get a restriction order it's not the end of the world - at least you won't have the stress of your debts and wondering how you're going to manage x

For starters the OR will see you have tried an alternative route before going BR - that will be looked on favorably. My only concern is that you have a credit facility, whilst knowing and being insolvent - that will not be looked on as favorably by the OR.
You wont be refused BR, but you could well end up with restrictions due to using credit whilst under an IVA. When I went BR in 2004, we opened a Nat West savings account - that was 6 years ago, so things might have moved on since then.
A good move in waiting until March before going BR - that way you avoid a NT code, thus not arising any suspicion within your companies HR department.

You will be fine and the overdraft will be included in your BR.
Unfortunately the Co-op are like that for some reason.
