Hi,
I would like to ask a questions, I live in tGermany for the last 7 years but I have a Romanian passport. Unfortunatelly between me and my wife we have about 50000€ own to the bank and credit card, my job is very unsecure right now if I lose my job we are finish. If I lose my job I am thinking to come to UK it is possible to declare bancrupcy there if yes after how long. If I have to wait 6-12 months will the creditors in Germany try to find me? Thank you for your response

Maybe it is time to start learning German? Presumably you have managed to learn some & you've learned English. It depends I suppose on the job you are doing, would it be difficult to get a similar one in Germany?

Hi Paul,
Thank you for all the info, I will definitely contact you next week. I don't expect any body to work for free and I think everybody should get pay for his work that including you.

But you are absolutely right what those company charge 10k it is not helping is stealing even more if I would have 10000€ to pay them I would keep the money and don't declare BR.

My main problem is if I lose my job I will definitely run in big problem because I don't speak German (even after 7 years) it will be all most impossible to find another job again to be able to keep paying the debt.

Several of the German companies are almost illegal, and several have been closed down.

For a large fee they will create a job in the UK, arrange accomodation. And then do the bankruptcy paperwork.

The official receuver will look VERY closely at these and if there is the slightest hint of bankruptcy tourism they may seek to overturn the application.
These companies cahrge up to 10k for the pleasure.

Always happy to give advise on the position on an individul case .

I don't know the BR rules in Germany so I can't say for sure whether you can declare BR and leave straight away or not.

It sounds like you have already made up your mind that you want to be rid of your debts as quickly as possible so BR is the easiest option. If this isn't the case then you should contact your creditors and try to work out some type of repayment plan if you do lose your job.

If you decide to try to declare BR in the UK then Paul Johns will be able to tell you the likely hood of the application being accepted. The other option is to use a German agency that specialises in helping you declare BR in the UK. They will know the current situation, how long you have to live in the UK, how to word your application, etc. The link to the TV spot that I posted mentions that the agency in that case charges €4000 for their services but if they guarantee that your application is accepted then it's not too bad a price for getting your debts cleared.

You can go BR in Germany & then come & work in the UK yes.

Thanks again for the info. This is something I should consider but I have heard that is very difficult in Germany. You may wait for 7-9 years then after the court may reject your bankruptcy after all sounds hard to believe but I heard it is very possible.

I will definitely contact Paul Johns in UK and also someone here in this field.

Being and remaining BR for 7-9 years that is ok (meaning this is the price I may have to pay for my mistakes) but the main questions is can I leave Germany and leave someone else like UK for example. At least I speak English. Thank you.

What happens if you declare bankruptcy in Germany? Would it stop you getting another job? Might be the best solution in the long run

By the way can you recommend someone in UK that can help with such of problem, or better do you do this also as a job? or only here as simply info and help? To make things worst after 7 years still dont speak german what a shame but is the reality Thank you

You will find it very difficult to declare BR in the UK if you have been in Germany for so long and all of your creditors are German. There have been lots of cases of people coming to the UK from other parts of the EU just to take advantage of the less stringent UK BR laws. This is especially true for people coming from Germany as there are agencies in Germany that even specialise in assisting German people in declaring BR in the UK.

There is no reason that the German creditors will not find you in the UK as you are still within the EU so it should be fairly easy for them to find you. They could also pass your debt off to a UK debt collection agency once they find you.

If you are unable to pay your debts then I would recommend you look into debt management plans in Germany.

Tf you have been living/working in the UK for at least a year and had been paying your debts during this time then you may be ok to declare BR in the UK but otherwise you may find your application refused.
