Posted - 30 December 2009 : 12:39:33 My husband and I have IVA in place although we were guarantee's for a lease and they are threatening to make us bankrupt. We have work and visa's arranged for Australia. Can we be made bankrupt in our absense if bankruptcy proceedings have not yet been served on us??

Posted - 30 December 2009 : 21:49:14 If the lease debt is not included in the IVA then the creditor could pursue you for Br.
Depending upon the amount of debt from the lease it may be possible to still have this included in the IVA.
If you are not continuing with the IVA then you should still look at becoming debt free either before you go or even after you are there and set up.
it is possible to be represented here in your absence by using a Lasting Power of Attorney
Posted - 30 December 2009 : 12:48:20 Yes you can be made bankrupt in your absense but not if you are in an IVA if no new debt has been incurred, did you sign the lease before the IVA
