Hi all. Just quick question. Our lap top has recently died completely. Fixing it would be complete waste of time and money. I have seen the advert for free lap top when you sign up with broadband. We are going bankrupt in feb. Would we be allowed to do this. Its not taking credit really because you pay monthly for internet connection not the lap top x

I would agree with John.

It is usual to see a busy clerk ask people to come back another day after filling in the forms correctly. They also don't like giving advice.

I have seen a number of the free laptop situations inthe last year and it is usual that:-

1. The OR gets grumpy that you have taken out credit ( 24 month contract ) just before petitioning for bankruptcy.

2. If the mobile phone company find out that you have gone Br they are likely to cancel the contract. This means that they will put a claim into the OR for the balance of the contract, which means that the OR will find out and be grumpy.

lastly the laptops are usually low spec and overpriced.

I would really recommend avoiding this course of action.

If you think you need to spend that each month then put it down.

I didn't have to provide proof of anything, but none of my outgoings were particularly high, and my car insurance had been paid in full. You normally only have to produce proof if something is high.

Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.

Thank you everyone thats very helpful. I dont normally spend that much but thats because we have been having to really budget to save for fees. But is it still ok to put that down because then we would be able to get the things we really need instead of going short every shop. Also do we need to provide proof of all outgoings. Car insurance gas electric etc. X

sadly not all BR clerks are as helpful as in your experience G.O.O.D. Most are great but I spend a good proportion of my working life going to court to submit debtor's petitions with client's all across the UK and, whilst there, have seen other's turned away as the forms were not completed to the clerk's liking. And with almost every court the clerk will glance at every page of the SoA.

This forum will help tremendously and you have already been directed to a very useful link.
Incidentally, 2 adults and 1 child can comfortably claim £450 per month housekeeping, £500 if that's what you spend.

The 'guideline' expenses amounts are available on the following spreadsheet - www.insolvency.gov.uk/DocumentLibrary/Policy/Excel/Household%20Expenditur.xls

Don't worry about completing the forms incorrectly. When I handed my forms in the BR Clerk added some extra information. The BR Clerk will only look at the name and address section. You will go through the rest of the forms with the OR during the interview.

You can also ask any questions here that you have about each section if you aren't sure and someone will answer you.

Thank you for quick reply john. I will make sure we look into cost before we do it. We are struggling a bit with I and e. Not sure how much to put down for things. Is £340 a moth for food exceptable for a family of 3. Worrying that we will fill in forms wrong and be sent away from court. Thank you for your assistance.

Hi
as the laptop will not be top of the range it's value would probably not fall into the category of assets worth collecting from your home and selling at auction. There would be little or possibly nothing left after collections costs and auction commission for the OR to make a contribution to your estate.

That said, be sure that you can afford the broadband monthly fee once bankrupt. It is not an allowable expenditure claim in bankruptcy unless required for your work. Thus the monthly broadband fee must be funded from the element of disposable income you have left after all claimable expense costs are met and any potential IPA payments, if applied, are made.
