Posted - 07 January 2010 : 15:20:12 back in december i got my info from experian and equifax intending to declare bamkruptcy in january. now i cant afford to until end of feb or even march. obviously i have been getting letters asking for payment because the debtors did not know where i was before this. now i have 2 letters saying they will take me to court or send representatives if i dont respond, these are lowell financial and hamptons legal (original letter was red debt collections) can i ignore these people until i can afford to go bankrupt. and when i go bankrupt what will happen to my 2 year old telly and laptop. i also have a motorbike that is worth around £600, could i keep that. i am also on incapacity benefit and income support. thanks. |

HMRC was one of my CCJ's thou
They promised to make me BR but took so long that the heat was getting hotter from other creditiors that i had to make myself BR.

If you are going to end up BR in the scale of things a CCJ will not make much difference.
If you have a chance of avoiding a BR, a CCJ will effect your credit file and may prevent you obtaining future credit.
From My experience The ones more likely to take you to court and obtain CCJ are HMRC, the utilities companies and Local council but again they tend to be sometime down the road

Posted - 07 January 2010 : 19:38:06 thanks for replies. i am clear now as to what the bailiff can and cannot do but i really need to know if these people would take me to court and what if anything a ccj would be against me when i go bankrupt. |

I would agree with gettingoutofdebts post. Is the motorbike your only form of transport? If so, and you need it for work, you may be able to keep it.

Posted - 07 January 2010 : 16:18:59 The TV and laptop will be fine and I wouldn't bother listing these on the BR forms. With the motorbike it will be up to the OR to decide whether you need transport to/from work or not. If they decide you don't then they may take the bike to sell and give the proceeds to your creditors.
If you can't afford to pay your creditors then there is not much you can do with the letters threatening to take you to court.
If you are on benefits you should only need to pay the reduced BR fee of £360 rather than the full £510 fee. |
