my wife is thinking about going bankrupt this year but i am worried about my own personal savings being included in the assets, are they at risk?

this is my own savings and wouldnt be hers speedily transfered to my account prior to the court date.

also does it make any difference that i am not actually living with my wife (at present anyways)?

I had some help from CAB for free

The forms are not that difficult, I just took my time, read them a few times and made sure I understood what they were asking before I filled them in and then CAB checked them and photocopied them for us for free

I think it is scandalous that some companies charge upwards of £2000 for that!

Kallis I agree, but some people do need the help and assurance that experience can bring. As long as that doesn't come at too high a price. I always explain that it is possible to do it oneself and am always happy to chat.

Personally, I would not pay a company to help me go BR, and no offence meant to the companies who post on here, their fees are not too bad.

However, it is possible to do it all yourself.

Horses for courses, some people can and do complete their own BR, I was menatlly in the wrong place and so confused, I could not think for the volume of phone calls and the endless supply of letters

I did not know where my bankruptcy fee was coming from or the cash that I spent to get proffessional advice But when we really looked into it, we found money that we did not think we had.

I am glad that i sought professional advice. I had lots of issues that needed to be resolved before BR.

you get what you pay for in life, yes Curly 15K sounds excessive and for that money i would want my BR petition etched on gold tablets!

I did telephone a couple of companies and went with the company with a good track record / reputation. I steered away from the factory production line Bankruptcy and choose the individuals who i believed could help me

Ah ah!!! We were quoted 15K to wind up the business and do 2 personal BR's - business only had one creditor and my wife had none (other than the likelyhood of business debt and house reposession debt)

We learnt so much from the site and had so much good feedback that we did it ourselves - initially we were terrified that the OR and Court would eat us alive if we had no one to hold our hand but there may have been only us and Judge Nutmeg in court on the day but still we knew everyone back here was rooting for us.

Ask, learn, do - this is what the site is for!

Hi Andy, I'm a qualified solicitor of 18 years now working purely on helping people in debt.This year I've walked tens of people through bankruptcy all over the country and some from this site. I quite agree - do not agree to pay any extortionate fees. The two links posted above will help you, but will not fleece you at all.

The BR fee is £522 at the High Court in London and £510 at all other courts.

There are some agencies that will assist you in the BR process. This normally includes completing the BR forms for you and possibly accompanying you to court on the day of the BR. The agency fees do not normally include the BR fee so you need to find this in addition to their fees.

There are lot of very dubious agencies out there that will try to take advantage of your situation and charge you lots of money for pretty much nothing. If you do want the assistance of an agency then you should use one of the two below:

my Husband phoned an insolvency agent today and they quoted £2000.00 as costs of banktruptcy I have read on the forum that it is around 500.00 is this when you file for BR independent of an insolvency practitioner??? Just dont know where money is going to come from although 500.00 is better than £2000.00 to find.

Andy, your savings will be safe, the OR will only be interested in your wife's assets.

Regarding the living arrangements, providing your wife files for BR in the same court I can't see there being a problem.

Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.

Hi Andy

The court will deal with your individual accounts seperatly as long as their is not a paper trail showing regular transfers between the two.

If one of you has moved out of the house you will have different Income and expenditure to a couple living in the same address.

My Local OR was very particular about the centre of main interest, Ie who had stayed at which address for what length of time and which court was the correct court to deal, i have had to work out my address for the last 6 months.

also do not forget that joint debts will transfer to you if your wife elects to apply for BR.

Andy I think from previous thread you are already BR, you have done well to build up some savings !
