Because of the 5 year rule, will the OR still have interest in the property I owned with my ex wife even though we split up in 2003 (divorced in 2005)as it just falls inside the 5 year period. I don't particularly want the OR contacting my ex wife and for her family and our old friends potentially finding out about my situation if she decides to tell them. |

Question 9.1 of the statement of affairs ask for details of any property that you have disposed of in the last 5 years.
No doubt you will have to enter about your divorce here, Perhaps even mention that it was very accromonious, Explain that since the divorce she has changed the mortgage details, you have not paid into the mortgage for X years, None of your debts are relevant to that property. Due to the divorce you request that the OR not have contact with your EX
I believe that question is put onto the form, so that the OR can chase any assets or properties that have been sold below market value, thus can claim money back for your creditors.
If you can show a clear break from the property for a significant time I do not believe they will not persue, If it is a recent change which yours does not appear to be, they are more likely to make enquiries with the EX

Posted - 10 January 2010 : 19:42:15 It was decided between us that I would sign over the property to her. She re mortgaged to another lender who she worked for at the time and so I know I'm not on the mortgage. I therefore assume I would have to be off the title deeds as well, as her Solicitor would have made sure of that.
