hi has anyone had a simlar experience as im having regarding ED and an IPA? i went brupt in April recieved a letter about ED in october filled in the agreement for the IPA and sent it off, to date i have heard nothing about setting the payments up for the IPA or about my ED i suppose i should have contacted them before now, but ive been hanging on hoping to hear from them. any suggestions?

In the last couple of years the number of bankruptcies has increased by about 100% and the number of insolvency staffhas increased by about 15%

The ORs have been very busy for a while now due to the large increase of people declaring BR. When I declared BR in May 2009 the OR's assistant mentioned that they would inform my creditors within 6 weeks that I was BR. The Clerk at the court advised that this would be more like 12 as they were so busy. All of the processes (informing creditors, receiving a letter to say that my car was exempt, etc.) took longer than people had previously mentioned.

There have also been a few people who have mentioned that their case has been transferred from their local BR office to another one in the same area as their local office is just too busy.

BR end March 2009 ltr regarding possible ED recd August time then nothing so assumed not getting ED then recd ltr yesterday advising ED granted 29th December 2009 :o) Think its just the massive back log the OR offices have at the moment that is delaying their usual time scales. Good Luck

Hi Atomic

First, as Richard P points out, ED is a bonus and not a right. You should not expect it as you could be disappointed.

The OR's are very busy at the moment and you will not be discharged until they are satisfied that they have completed their investigatioons.

To confirm the message by gettingoutofdebt, an IPA can not be commence once you have been discharged from bankruptcy.

thanks for your replies its good to know that someone is out there to help.I have checked the register still BR im not too worried about that i can wait a few more months for that its just the IPA as i sighned and returned the paperwork and recieved a copy back then nothing! does anyone know if they can start to collect it once im discharged being as i have sighned to agree to it?

Check the Register (http://www.insolvency.gov.uk/eiir) as I received an ED but wasn't informed by the OR about it.

If you don't receive an IPA during BR then you will never receive one.

From other postings it can be about two - three months before a discharge is confirmed , have you checked the insolvency web site ? that is sometimes updated and the individual not told !

as i understand it if you have not had arrangements for IPA before discharge it will not happen, unless they find out that you have made a serious missrepresentation on one of the forms in which case in an extreme circumstance they will call you back (very very rare).

As I am sure that housing and others will post ED is a bonus and not a right. I personally would not chase the OR , you would not want to remind them and then they chase you for an IPA
