Posted - 12 January 2010 : 20:14:06 I am currently doing the forms for bankruptcy. I have outstanding council tax from my ex husband. As he left and I stayed in the house for a year, the council tax that he didnt pay was liable to be paid by me. I couldnt pay. I am on benefits and now get council tax benefit. The ballif has been out and I have paid him £200. with him saying that the remainder needs to be paid by march.(£1200)
My question is when I am made bankrupt does this debt get added onto that. When I said this to the ballif he said that council tax debt still has to be paid.
Any ideas?

If it helps , I had court orders against me from the local council (and councils that i had rental properties in their area)
I included all of these in my bankruptcy.
I believe that you will not be able to include it in your BR, if it is a court imposed fine.
Clarification not a court order but a court conviction, (conviction is when they find you guilty of doing an illegal act, a court order is one of your creditors using the law to try and get money owed to them)
To try and keep one of the court appointed bailiffs away from the house i did agree to pay them a monthly instalments . Think I paid two amounts before i went BR.
The OR has written on my behalf to the bailiffs and told them to bog off (well I suppose they used nicer words).
get your court date sorted and start planning the rest of your life

Posted - 12 January 2010 : 20:21:02 I presume they have a liability order. if so then the debt is proveable in the bankruptcy but this does not stop the baliff from destraining on your property (in theory, but i have never seen it actualy happen)
