How long have you got to vacate your property once you have been declared BR, if you no longer are keeping the house??

Hi

As has been said, you will not lose your home to BR as you are in negative equity.

make an appointment to see your local council Housing Options team. Present as being threatened with homelessness.

They are obliged to offer advice and may be able to assist with assitance with deposit/rent in advance - if you are in a priority need group

As the property is in negative equity, the OR will not be interested so I suggest that you negotiate with your mortgage company. Whilst the shortfall in your property will be written off when you become bankrupt, any bills incurred after that date will be your responsibility.

If you have a family, it could be several months before you would be evicted.

ok, there is negative equity in the house, we can't keep up with mortgage payments and secured payments, so we aren't going to buy the BI and plan to hand back the keys. We are finding it hard to get the right rental property for our money and situation. Our court date for BR is 28th Oct, if all goes well and are declared BR. How long would we have before we have to leave the property we are giving up on??

A lot depends on whether you have anyone living with you and whether the Official Receiver has an interest
