Posted - 17 April 2011 : 17:18:56 Hi all,
would be very great ful for anyadvice help someone may be able to give as i am having sleepless nights over this, went br in 2008,been in house ever since while OR waited for prices to rise which they did,was allowed to remain in house while i looked for work of which i still am.House went on the market voluntary sale 2wks ago as i didnt want my s2bx to lose out financially however the insolvency people have told her she has to cough up legal fees which i think stinks as its only me who went bankrupt and shes been left in this position. and sold in 2 days just cant believe it all paper work has been done and i am being asked to sign nothing by lawyers lender etc which is fine by me,however,do i have any rights to remain as when it comes down to a completion date its looking like i wont be able to find anywhere soon enough especially regarding my employment status lack of housing in general in my area,
would they need a court order to make me leave or is it just a case that i have to leave once a completion date is given etc.
any advice most appreciated.
regards

Posted - 22 April 2011 : 13:01:28 Hi richard,
many thanks for getting back to me well i have had the wk from hell the solicitors working for the OR are saying i have to comply with all aspects of the house sale,as if i dont they will bill me for all costs,i thought as the house was an asett in br the fees would be taken from this,i am guessing they will apply these charges after the point of sale & creating a fresh debt for me.
You are discharged - no IPA - no BRU? YES
The house is in joint ownership - the other owner is a partner? S2BX
Is there equity?5OK
What is the ORs position? For me to vacate on the completion date or else!
Is the property on the market now?was and now sold.subject to the last bits of admin i am guessing.
i am just trying to buy me some time so i can find a 1 bed flat etc this whole thing has turned my life upside down, have told the sols i would appreciate some time but i bet they wont budge,i think i will get a date of the end of may to leave my /our home.
any advice if possible would be very much appreciated.
regards
