Posted - 22 November 2009 : 17:43:51 Hi I am a 50 year old man annd I have been running and bee in heavy debt now for over 10 years. I'm a nice guy ...but this post will make me look bad...I have been desperate and taken some desperate steps to try and resolve my debts. From my 1st marriage we had a lot of debt...not paying bills was one reason....I have always earned fairly good money so don't know now really what happened all those years back. We ended up 10 grand in council tax debt...and I think that is where my problems started. In the here and now I believe that all the debt I acrued after that I paid on time and well untill the 10 grand caught up with me...and I'd panic and fall apart again. My good intentions and payments went into freefall...and I was running again. This happened so many times and once...I met a girl and married her fooling mysef into thinking that in a little while the house that we bought together (explain that bit in the next paragraph) my share of the equity would pay off my debts...how desperate is that? She paid the deposit...and the mortgage was in her name...she was fantastic and I was a fool. She found out about the debt...and that was the end of my second marriage...there is no equity...the recession saw to that. The 10 grand I have just discovered has been to court several times and there are even warrants for my arrest for it! I don't know what the outcome of that will be...I can climb mountains...would face a lion...walk through fire and even have dived with sharks unprotected...so I am no coward...but boy this REALLY scares me! Bankrupt this week!! I hope.

if it makes you feel any better my numbers were worse but that makes no difference as once you are in too deep, you need avenues to deal but their is a light.
Reading your entry still not certain that BR is the only route for you ?
can i suggest that you speak to Paul at Reviva (one of the experts on this site) he helped me position myself so, I had provisions for the month after BR, every thing was put in order before the big day.
he will also review your circumstances and provide guidance
think that your court may be winchester for BR
which area is the council tax warrant for ? Just want to make certain that they do not mess you around and send you around the country chasing the warrant

I think including the car my debt stands at about £50,000...hard to believe I know...how the heck did that happen?
I work as a project manager and I am so tense with all this I will be surprised if I don't end up having a heart attack!
I am shaking and sweating trying to deal with it!
I live in Basingstoke so imagine reading or Basingstoke to be the court to go for BR.
How does the BR work with bank accounts...should I clear the money from what will be a 'frozen account' into another account to hold untill the new account is opened...just wonder how I would last the month if my money is frozen? |

Posted - 22 November 2009 : 18:25:37 Hi Richard Thanks for the reply...I am alone these days (no surprise there after the way I have behaved...Though the intial 10 grand debt should be shared with my 1st wife). I know that I had motives for my second marriage...I did love her and regret everything. The warrant won't go away?...no...I dont suppose it will...How scary is that |

i do not know from your posting how much debt that you are but do not rush into BR, yes it has to be soon but very few courts have a walk in service.. post your area that you live and i am certain that one of the many people on would have had experience of that court
get all of your personal effects in order, car, pension, savings, BR payment, if you are uncertain of the process or are so confused with the BR system then email one of the experts or post on this forum further
Then arrange to deal with court warrant, i can speak through that process on this forum if you would like. Get a solicitor to deal with warrant but a debt specialist to give you advice on your financial affairs
I doubt that you will be allowed to include the court fines with your BR but may be allowed to include council tax.
except the council tax do you have other debts ?
are you currently working ?
Asite the unknown is the scarry bit, Bankruptcy when you understand the system is about taking controlled small steps at a time, The court clerks are helpful and they do not judge.
I have found the people on this forum to be non judgemental, most of the people who post have had similar experiences and SURVIVED, they are posting to share experience and help each other with the small steps

no your not a fool, hind site is a wonderful tool which non of us have the advantage of.
well done for at last wanting to address you issues.
the court warrant will not go away, when you have had the chance to start getting your other issues in order and before making approaches to any government body
speak to a solicitor for the court warrant, phone the local court and police station that have the warrant live and arrange atime to surrender .. normally morning of the court at about 08.30... never a friday evening , bank holiday or a day a court is not sitting or htye have to keep you in to the next court
i am going to continue answering your points in my next posting but having computer probs so do not want to loose text
