Hi, I am about to declare myself bankrupt and am on incapacity benefit at the moment. I rent my home with my husband who is in full time work, we have no assets at all.
My question is, as this is a marital home how will they establish what belongs to me and what belongs to my husband?
For example do I have to provide receipts to prove that his games, consoles & p.c.’s belong to my husband, how do I protect his belongings please?

Hello bill, and welcome to the forum. The items you described are normal household goods and do not have to be declared. If you had a Monet painting or 2 of course you would have to declare them.
Please ensure all the debts are in your sole name. If not the creditors can come after your hubby for payment if he too signed on the dotted line along side your signature for loans, store cards, etc.
Also, seek professional advice because the District Judge will ask you and if you reply no s/he will not grant it and it will be a waste of £485. You state you are on incapacity benefit. Check with your local county courthouse and find out if you have to pay the court cost; and if you need an appointment to file the bankruptcy application.

Hi I am not an expert just someone who has recently gone BR,
with ref about your home if the lease is in joint names check with your contract in regard to you petitioning BR, saying that usually rented accommodation is not normally affected.
With ref to assessts for example, i think the OR will only be interested if you own very exspenive items eg plasma tv antiques this sort of thing, and you should only put down what belongs to you if it is only you who is apply BR.
It would be very rare the OR would come to your home to check what you have, but you need to be honest on your forms then this way there would be no come back later on.
