Posted - 18 February 2009 : 17:13:51 hi there i got divorced september 05. and are considering going bankrupt. on bankrupcy form it asks if been divorced within 5 yrs.
at time sighned house over to ex wife equity at time was around 66,000. we settled with me having a charge on property for 22,800 and she left my company pension alone, payable when my youngest of 2 children reaches 18 which is another 12 yrs away or she remarries, cohabits etc
would the reciever be able to demand this money from ex wife and force her to give them the money?
advice would be much appreciated.
not sure i could hold out going bankrupt another 18months to not get her involved.

Posted - 19 February 2009 : 10:19:47 thanks for reply. house has increased in value not sure how much though. mortgage was for about 70k prob worth in todays market around 150k-170k

Posted - 19 February 2009 : 07:33:06 If she has the children she would have been entitiled to more anyway & you got to keep your ppension so it sounds a fair enough split so I can't see any problem apart from if the OR wants to sell the house to get your part of the equity but I don't think waiting another 18 months necessarily solves that. Has the house dropped in value do you know?
