Posted - 20 March 2007 : 12:06:31 my dad has been made bankrupt at the end of jan 07. 3 members of his family including himself, me (daughter)and my husband all have contracts with vodafone in my dads name. will any of these contracts be affected by my dad being bankrupt? i am asking this because talk-talk have canceled his land line phone & broadband today even though he has paid the bill in full when it was due last week, is this also a possability due to bankruptcy? also can anyone send me a link with any information relating to the rules of bankrupcy reguarding existing contracts, ie..phone bills, car insurance etc... thankyou

Posted - 20 March 2007 : 18:54:08 That's how I feel - if they want to cancel the contract it's their loss. I will either get Dave to take out a contract in his name and pay him, or get a pay as you go.
I'm sure he'll look stunning with the pink phone!

Posted - 20 March 2007 : 16:42:17 Thanks Skippy, I suppose if the contract was cancelled it would be no great hardship, after all, they can't chase him for money and he can always get a £29.99 mobile from any supermarket nowadays (plus i have a lovely little pink phone if he's really desperate!!) lol |

Posted - 20 March 2007 : 16:06:00 Hi Helen, when I spoke to Vodafone yesterday they told me they have a bankruptcy department and if I have any problems with my account that I can give them a call. It might be worth speaking to them.
Good luck to your partner on 22nd!

Posted - 20 March 2007 : 15:34:58 I was thinking the same thing! My partner has a contract with Vodafone and his car insurance and he files for bankruptcy on the 22nd, (2 days!!) Does he have to include those in the bankruptcy, he didn't include them in the DMP he was in and hes never missed any payments with them. |

Posted - 20 March 2007 : 14:48:58 Sorry DD, I'm being thick here. I don't understand why watweb's father shouldn't pay the phone bill? I thought you could still pay utility bills. Does that mean that I should stop paying Vodafone (they are not one of my creditors) when I petition for BR? I spoke to them yesterday and they are happy to keep me as a customer (I know that could change), and I have not mentioned them in my BR petition as I don't owe them any money.

Posted - 20 March 2007 : 14:41:15 hello watweb, these items you mentioned are in your father's name only? If they are you and anyone else who had services under his name will have to now get their own individual credit agreement with, mobile phones and insurance.
Talk-Talk was probably notified by the Official Receiver that your father was bankrupt and closed the account. What I can't understand is why he paid the bill last week when he petitioned Jan.7? He could have listed them on the petition. Inform him NOT to do that again, please. If there are any creditors not on the OR's list tell your dad to give them to the OR NOW. Your father can't favour 1 creditor over another. They all have to share from the OR's 'pot' of money.
Usually with a bankruptcy the car insurance will be paid in full. No monthly payments allowed as this is considered credit. Same for the mobile phone. Hope this helped.
Contact the CAB for specific questions or the Insolvency Helpline .
The IH number is : 0845 602 9848. They are very good in answering any questions that pertain to bankruptcy.
Take care.
