Hi,
I'm new to this forum, but there seem to be plenty of people here who can help me so here goes:
I declared myself bankrupt in June 2009 due to becoming overwhelmed with demands for money from my creditors. I was (apparently incorrectly) informed that once I'd declared bankruptcy, that was the end of it and I could actually afford to buy food for my family again.
Unfortunately, I am now tied to the official reciever (MoonBeever) who asked me to send my payslips. Obviously I sent them. At the time, I had quite a large amount of overtime on. They decided I had about £350 per month spare. Now my overtime has stopped (I've stopped working it because I'm making myself ill working so many hours) so I'm now coming home with about £240 per week. By the time I pay my rent, bills and shopping, I only have about a tenner per week left.
My question is can I renegotiate with MoonBeever if I send them my current basic payslips? Due to me falling behind, I had to increase my payments to £100 per week which I obviously cannot afford now.

What would happen if they don't agree to accept less money and I don't/can't pay?

Also, I was under the impression that I would be freed from bankruptcy after 12 months, but we're now 16 months later and I haven't heard a thing about being freed from this! I understand the repayments have to be for 3 years.

Apologies for the long post but I'm getting desperate now! £100 per week from my £240 per week pay is ridiculous! We are going for days without food at the moment!

Any help or advice would be appreciated! Thanks in advance.

Hi and welcome to the forum.

Contact Moon Beever as soon as you can to ask them for a new I & E form. There's no need for you to struggle like this as I'm sure your payments can be changed. I had a pay cut while I had my IPA and had the payment reduced without any problems.

Unless you were notified otherwise you will have been discharged from BR after 12 months. If you are discharged automatically rather than getting early discharge you won't be notified by the OR. You should find that you are no longer on the insolvency register, but unfortunately the site is being upgraded at the moment - have a look when it's up and running again.
