hi my ex husband still lives in our old house of which we are both named on the mortgage.he says he is going bankrupt can anyone tell me how this will affect me and will i too have to go bankrupt.i cant afford to buy him out as im on benefits with 2 children.can anyone help????

how long have you been seperated and away from the premises ?

normally with joint and severally liable debts like Mortgage the loan provider would hold other party responsible for whole debt.

However if you can show that you are no longer responsible for the property and in effect have not had control for a long period of time you may ahve a good argument.

How are things between you and EX, if you can still speak and are prepared to speak to each other in company of third party, I would suggest talking to one of the experts, timing in these issues is very important.
