Hi all, it has been a while since I have been on here as we have been moving into rented accomadation and trying to settle in.

We have been out of the house for a couple of weeks now and have not contacted any of our creditors as we aer now looking to go BR ASAP.

I am just about to start filling the forms out and was wondering if anyone has any good advice on filling them out. TBH I am finding it a bit daughnting the thought of filling them in but I need to get them done so we can go BR & let the mortgage company have the keys back to the old house.

Any advice would be really appreciated.

Also we have a caravan worth around £1200 which we use as our only getaway and as my wife suffers with bad depression (on incapoacity benefit) it really helps her when we go away. Our parents usually pay for the site fees so would be be able to keep it???

I haven't had the experience of the mortgage side, been in rented since splitting from the ex. But i would imagine if i was in that situation and planning to go BR very soon i'd just tell them what my intentions are. Probably get yourself a date first for your BR though. Just my thoughts i'm no expert in this so you might just want to get some professional advice first.

You will be fine it just probably all feels a bit daunting right now but it really does get easier i promise.

I hadn't gone br then so not sure sorry may be just tell them you can't afford the payments and would like to hand back the keys

Good idea, haven't got the number on me so will do it first thing Monday. As you say it will be something to aim for and will definetly make it feel more real!!!!

How should I word the letter to the mortgage company as I haven't gone BR yet.

Do you mean writing to your creditors to advise you are going BR? If that's what you mean I wouldn't bother unless they're really on you rback for payments, it's just another thing to do that's not really necessary.

Have you contacted your court yet to set a date yet? If you haven't and you want to keep things going as smoothly as possible it might be an idea to book a date as some are quite booked up (at least you know you're not the only one in you area!!). It might feel a bit daunting but once i had set my date it was something to aim for, also makes it feel very real. Just a thought thats all.

Hi regarding the handing back of the keys i informed northern rock of my intentions they sent out a form which just asks for the address and that you understand what you are doing the date you intend to go.Once you leave the property you LEAVE the keys behind and they change the locks. hope this helps

just to clarify, whilst the rental agreement lists the conditions including those regarding bankruptcy, it does not state that you are required to inform the landlord in the event.

In my experience, and in the present climate, landlords are interested in one thing, receiving the rent on time. I have yet to hear of one evicting the tenant purely based on the tenants insolvent status.

Re: Tenancy post!

It looks to me like a standard letter/agreement. They have to do these in all cases and at this moment in time i would not worry about it.

I would as i think i suggested before make an anonymous call and ask about any clauses and what would happen if after a tennancy has started and the tennent was made BR what would happen.

I would also like to add that as long as they are getting their monies and you are a good tennent then in this current market beggers can be choosers and to have an income from a home is better than to leave it.

Give them that anonymous call, i would:-)

I just found this quote in our tenancy agreement..

"11 Enforcement of Obligations
11.1 If at any time during the Tenancy:
The Tenant fails to pay the rent or any part of the rent for more than 14 days after payment is
due;
The Tenant fails to observe or perform any Agreement or obligation under this Agreement;
The Tenant becomes bankrupt or enters into a voluntary arrangement with his creditors;The Tenant leaves The Property vacant or unoccupied without The Landlord or The Agent
consent;
Then The Landlord will be entitled to take immediate steps to recover possession of The
Property from The Tenant by issuing proceedings for possession in the appropriate Court or
Tribunal. In the event of The Landlord taking this action this will not alter any other rights or
obligations within this agreement unless the Court or Tribunal rules otherwise."

Do we notify them ASAP or wait until we have a date with the courts? I am now worried we may be kicked out after only a few weeks!!!
