 im surrending my car on HP what do i do about ins

Hi

I have decided to surrender my car which is on HP, it has £3000 left to pay and is going to need repairs soon, a new gear shaft approx 1k and brakes £300 and taking the costs now £220 a month and those and being on long term sickness for depression I have decided to surrender it.

The HP Company wont let me voluntary terminate the contract as they want the OR too, however i dont think that is right I have wrote to them and asked them to close the account down.

Im not driving it any more, makes it better that way for me in a psychological mindset sort of way, so do I need to keep it insured or can I cancel and close down the insurance and do I need to keep it road taxed whilst its on my path, if I dont need to keep it roadtaxed and the road tax runs out in April will I get a refund and how? And the same for insurance, can I can cancel it as it is on my path but I am still the logbook keeper and will I get a refund if I only took the insurance out about 4 days ago.

well i have wrote my letter for GECapital and am going to send it on Monday I have said:

"Dear Sir Madam

Recent to my letter the other day, I am writing to inform you that I wish for this car agreement to be terminated.

In respect to this I have cancelled the car insurance agreement, cancelled the road tax, cancelled the direct debit and registered the car with DVLA as SORN.

I can confirm that as I have registered this as SORN, That I am not the registered keeper of this car and therefore am not liable for it.

I can also confirm that the car is in an OK condition with one slight bump to the right hand passenger side.

I am unable to drive this car to another location so request that you send a member of staff to collect the car, and to sign your part of the V5 Document if applicable, please can you make sure that this is done within the next 10 days.

I can confirm that as I am going bankrupt, and as you firstly requested a letter from the official receiver, I have left this car on my statement of affairs as a secured creditor, I can also confirm that any monies left to pay, and any charges that you levy to this account, will be absorbed with the bankruptcy, please ensure that after collection and after the 26th January 2009, that any communication is between yourself and the appointed official receiver. After the 26th January I will no longer discuss this account with your team, and as from 17th January I will not be held liable for any damage, theft or destruction of this car, but will comply fully with you in collecting the car.

Yours Sincerely"

Sounds like a good plan now coming together. I do hope that its works out for you, not sure about the bit saying "A bankruptcy specialist" as it may come back and you will have to explain who told you and we are only able to help with little bits, its free advice and not always to be taken as face value, at the end of the day that final decision has to come from you.

For myself only i need to add in that i dont know the whole process i have learnt only from my own experiences and i would not want to get you or this great helpline in trouble thats why i always say "i think" but i am not the law or a bankruptcy specialist.

I am here as a pillar to lean on and to help where i can, but i am not as knowledgeable as Julian, John or Paul.

SORN Application done, road tax form completed for refund and ive noted on section 13 of the forms that I have spoken to a bankruptcy specialist and they ahve said to write to ge capital, cancel the road tax, insurance and make vehicle as sorn, but at the time of printing the bundle I didnt remove these so please do.

Hope thats ok too

No you can download and print the form but you cant claim it back online.

Glad to hear about the insurance now dont drive it.
