Will a bailiff come after I petition the court for BR? Also, I have a laptop worth £300. Can he take that? I am on benefits.

Thanks.

After being declared BR the bailiffs cannot touch you or reclaim any of their goods as everything will be done through the OR.

If they contact you just provide them with the BR number and the ORs telephone number and if they turn up on the doorstep just do the same. Once they hear that you are BR they will leave you alone as they know that they cannot get any money/goods from you.

If you don't use the car to commute to work/take the kids on the school run/have mobility then the OR may take this off you to pay the creditors. If you are medically sick (i.e. have a GPs note/receive benefits for the illness, have mobility etc.) then you may be argue that you need the car to get to/from the shops and as the car is worth less than £2500 it should be ok.

Thank you for the replies. My other asset is a car worth £2000. I am sick and don't work so I get Emplyment Support Allowance. I don't get motability. Will a bailiff come for the car?

The bailiff shouldn't come unless you have assets that the OR thinks should go to pay your creditors. If you pay an IPA then this will go to your creditors to cover some of the money they are owed.

The laptop should be fine and normally it is only cars with a value of more than £2500 that are seized unless you have a car of a lower value that the OR deems you do not need.

The OR will contact all of your creditors that you detail in the BR forms but will also advertise in the London Gazette to allow any other creditors to come forward.

Be completely truthful on the BR forms otherwise it will be considered purgery and could result in a prison sentence.

Hi

I don't think a bailif will come. The idea of BR is to stop this happening.

Maybe it depends on circumstances ?

Sorry if I wasn't clear. I'm confused. Will a bailiff come as a consequence of being declared bankrupt? How else will the OR know what assets I have that can be sold? Or does he rely on me being truthful? I have read that BR provides protection against bailiffs. What does that mean?
