I have a question,
I had already picked up the BR forms from the court a few months back when i came to the point that I knew there was no return , but i was then made redundant and now I am left wondering how i should fill out the I&E part of the forms as i am looking for a new job daily ?????
Just about had enough last week and had to go and see the Dr's , how was quite concerned about my mental state and has now put me on anti depressants ??
If anyone could let me know how to sort this form out i would be very happy as i feel like i have just sailed off with no paddle !!!!
Also have credit cards ringing all the time now and i just can't give what i have not got !!One of them wants to take me to court now :o(

Well my day in court has been !!!! and gone !!!!!
To anybody going through this i know that like me you will be sending yourself crazy !!!
Yesterday i arrived at the court for my 9:15 app.
The court clerk was fantastic and told me to take 5 and to get myself sorted as she could see i was in a state...anyway went through my details and forms that i had completed online , took my money and said she would she if the judge was ready.
Five mins later she came back and said the judge was fine with it and did not need to see me !!!!!!
She then asked if i wanted to pop out for a drink as it may be a while before the OR got around to calling , with that the OR called and i had my first phone interview.
Just waiting now for the OR to call back to sort out my full phone interview !!!!
All i can say at the moment is that everybody so far has been GREAT , the court staff were fantastic and the three people i have spoken to at the OR have also been realy nice to me and told me not to panic as i am by no means alone .
It was all over in just over an hour !!!
The OR will let me know about my car but can't say anything official at the moment until i have had my full interview , but as i live in the country and i am looking for work and need the car to do so , they can't see at the moment that they will have any interest in it .
I also have a mobile contract that is ending this month and they said to let it end if i can pay it as i don't owe them anything and it would just complicate things at the moment.
I will post again as things go on and keep uptodate , i have had three calls this morning from credit cards MBNA were fine !!!!! , barclaycard are trying to be stupid about it at the moment and halifax just put the phone down on me !!!!! Nice eh!!! after all the money they have had from me over the years , prob. more that i owe them now !!!!
Just one more thing and that is to say a VERY big thank you to everybody that has helped with comments and post's so far , i was great to know that i was not alone on this road and there are many others walking it with me. Once again THANKS and i hope to keep posting and trying to help others with the pain and worry

I will be sure to let you all know how i get on the 11th , this has been a hard choice but looking back now one i should have made a long time ago !!!!!
The one thing that i am looking forward to is being able to apply for a job again and not have to worry if it will cover my debts , as long as we have food on the table and a roof over our heads anything else can wait.
Prob be back with more questions soon...
Thanks again everybody

NeilH,

Well the end is in sight - good luck for the 11th November, and keep us all posted on your journey. As Richard states, have a visit to your local court, and get a feel for things.

Gd luck and keep posting.

Hi Neil

good luck for the 11th

the court buildings can be quite scarry if you have not been to one before.

most courts have a coffee shop or public area if you have the time go into the court a few days before and have a nose around, i would suggest doing so as it may calm some of the apprehension.

to confuse it further in some courts you do not even need to see a judge or go into a court room, my wife went into a private room and all the court official did was check the info, swear an affradavid collected the money asked a few simple questions about the completed forms, the court clerk made my wife sit around for 45 mins and then brought over her bankruptcy paperwork.

if you feel brave enough on your rekkie visit take a friend and ask them to ask the clerk about local court procedure

good luck keep us all posted with your progress

regards Richard

No Make a date with your local court:

That was a tongue in cheek remark Jane regarding the use of Credit Cards to pay for the BR fees

The bankruptcy fees have to be paid in cash, the courts do not accept cards (or they didn't last time I checked)

Don't worry about using the overdraft, we used ours for 2 lots of fees, the OR never said anything even though I suppose it is not really the moral thing to do, you could always say the overdraft was used for "living expenses"
In 2 Deep Posted - 22 October 2009 : 20:19:49
NeilH,

You put down consolidation as the reason. Do not worry about using credit to pay credit. That is just one stage you go through before realising you have a debt problem, and the OR will recognise this.
With regards to paying your BR fee by use of your overdraft, I would refrain from mentioning this to the OR.

You could always ask if they will take a credit card to cover the BR fee, before cutting it up

I have another question about the forms ?????
When you are filling in your creditors and they ask what the debt was for....
Most of my recent debt has been paying cards with cards by drawing out the cash and paying another card ,what on earth shall i put ????
