 worried and need some advice

Hello all,

The time has come to file for bankruptcy, I have spoken to cccs some months ago and they advised me to file for bankruptcy but I thought I would try to weather the storm but work has just not picked up and the credit companys are getting rather stroppy and continue to bully me and now a company called dl collections have demanded the £160 I have left each month which leaves me no money to pay any of the others i was weak and agreed to set up a direct debit which comes out on friday, I have filled out the petition and am just wondering how long all this takes should I cancel the direct debit or will they send collectors around as soon as I cancel it. I'm at my wits end I haven't had a good nights sleep in months and its always on my mind but I just want it to all go away.
Also what happens with money owed to the tax man, I'm supposed to make a july payment of £3500 which I really do not have.

Any advice would be most welcome.

Glad it went ok in court.
Your creditors have missed their chance to help you resolve your debt problems....have fun telling them!
I opened my new bank account the day after going to court - join the rest of us with a co-op cashminder account!!!

Hi Jon,

I would suggest you get a new account open ASAP. It's hard to tell when your existing account will be frozen, so best act quickly.

Thanks Vicki, The court where really good and I didn't have to meet the judge just have to wait for my interview now but I'm looking forward to speaking to my creditors. whilst I'm waiting for this interview can i open a new account so i can be paid?? How long will it be before they freeze my account?

Hi Lodgey.
Just to further put your mind at rest, the court won't touch your account.
When I went to court, I had a brief conversation with the OR and she asked me if I was ok for money and had access to money.
Once they announce your BR in the press etc, banks tend to freeze your account until they hear the OR isn't interested and in some cases altogether if they are not BR friendly.
So, make sure you have withdrawn cash you need, the OR won't act immediately so don't panic this morning, and just be aware that you may need to open a new account.

I hope everything goes ok today - I am sure you will find all the court staff really understanding.

Sorry for the slow reply, Julian my total debt it £31k
which includes tax ect. My court date is tomorrow and to say I'm nervous is an understatement but gotta do it one of the credit company's has sent me a final demand and I have £21 in my account!
One last question I get paid this week not sure which day, will the court take all moneys in my account if they do I wont have enough for my rent and bills??

Just would like to say that this forum has been a big help to settle my mind keep up the good work.

Great feeling isn't it storm!
After months of letters, phone calls and threats of CCJs and bailiffs - the mention of BR soon has them retreating.

What a job to have - chasing people for debt - I would be useless! Then again with my "wealth" of experience in debt (!!) I would probably make some wiser decisions when it comes to repayments!

Hi Lodgey

Cancel all your D/Ds that are paying debts just pay the ones you are using ie gas elec water phone net etc

Also if you are going the BR route you may have to change your bank account, Barclays cashcard or Coop's cashminder acconts are the two mainly used that are BR freindly.

If you start getting the phone calls because you stopped the D/Ds then tell them that you intend petitioning BR they leave you alone. I just had SWALEC threaten me with a CCJ told them I aint bothered as I was looking into BR they hung up and left me alone that was last week so they know my intentions.

Brett and Vicki are correct you can not let the Debt Collection dictate to you that you have to give them every last penny.

Your tax would be included in the Bankruptcy.

It looks like Bankruptcy would take away the pressure you are under.

Can I just inquire as to your level of debt and asset situation?

I have just gone BR and it has been such a huge weight of my mind and I am sleeping at night!
Contact your local court and find out when you can go with your petition.
Don't be bullied by debt collectors - if your creditors had been more reasonable in the first place and helped you then you wouldn't have been pushed into BR.
As soon as you go to court you will get your BR number and from there on any creditors deal with the Official Receiver.
You will get lots of support from this forum so ask away!

Hi Lodgey,

Welcome to the forum,

I would cancel the direct debit if you can not afford this.

Contact your local county court and find out if you need to book the appointment for your Bankruptcy or whether it is a walk in court.

Although the debt collection company could well send a debt collector around they have no right to entry and can not demand money from you. They need to follow the correct legal procedure of a county court claim.

If you declare yourself Bankrupt then money owed to the tax man will be written off along with any other unsecured debts you have.
