Hello again everyone,

Not too long ago there was a topic posted on this forum entitled "Dazed and Confused" and without wanting to replicate that thread I wanted to say how confusing the horizon still looks.

Having investigated with Gregory Pennington, the CAB, this forum and it's experts I am still cynical when it comes to the issue of "free and impartial advice". I was certain this morning that I would be persuing a route into BR as soon as possible, I wanted to heed the advice of numerous postings on this forum and complete the process by being totally honest and that this honesty would result in a fair and reasonable settlement both in court and with the OR.

I am now once again confused to receive advice regarding the use of yet another service that would charge fees relating to setting up a BR plan? Maybe I am mistaken but many on this forum appear to be perfectly able to set up their own BR petitions, appear at court and inteviews with OR's on their own, fill in the required forms individually and cease to pay their creditors to save up their BR fees of £495. It seems that being in full time employment and earning a fairly decent wage and offering to pay your creditors a realistic amaount whilst still reserving some money for the BR fees (regardless of debt) always seems to end up in advice regarding a company that will "Do all the hard work for you" but for a fee.

Maybe I am being too cynical but is it a good idea to just simply jack my job in, plead poverty, claim benefit and let the creditors fight over who gets the lion's share of my £1700 2nd hand car?

A very cynical, tired, confused and dazed mst.

Whether I choose to take onboard the help of Brett England or not I am still very positive with regards to my future. I for one will be posting on this site regardless of how my BR goes because as I have already stated, things cannot get any worse than they are right now.

I was thinking to myself earlier how great it would be, to know what your expenditure would be from one month to the next, and I tried to imagine what it would feel like to have an amount of money to live off, with no credit available, and that any extra you had at the end of the month (be it £10 or £100) was yours to spend on a meal out without the need to feel guilty afterwards, then I started to get dizzy and reverted back to reality.

And Vicki, you are an honorary expert in my opinion.

Cheers abd - you're a star!
I feel priviledged to be called expert but it's a lot to live up to and I would hate someone new to the forum to think I know as much as the real experts. I learn something everyday and am totally addicted to the forum and love helping others where I can.

Julian - what do you think?

well Vicki,I used honorary with intention not under value your experience and knowledge, but to put you in your proper position with the forum respectful experts and at the same time to be careful not to make them feel threatened by your expanding insolvency expertees. With the permission of the forum experts I seconed you in using the title honorary(you have my absolute vote).

Well said abd! I like my title... "honorary expert" .....can I have that as my title Julian? Then I don't need to explain I don't know everything to new posters!!??

Hi mst
not proud of but I had more gambling- related debt than your whole debt.I had to talk honestly about that to OR, abit painfull for me to recaLL and face the reality, but believe I did not sense at all that I was causing them a surprise.they continue to be nice ,empathic and polite all through the interview.
As i hve said I had your anxiety an even more before the whole process.I think I got subtantial support and confirmation from the expert in the forum and the main honorary expert Vicki.that was a free psychotherapy session for my panic attack.
Just as an advice, as a result of that I paid a firm a small amount of money to look at my form and say ,well done you do not need to make any changes(in other words I through my money through the window). I think Julian made a good ,and fair point
here regarding having an asset and the need for help, otherwise do not panic and do it is my humble advice. wish you all the luck and hope will chat when you are thousands of pound lighter, then debt free

Hi Vicki,

The OR has heard everything imaginable .... I've yet to see one surprised :)

Me too - not a single asset to show for £63k of debt!
I had fantastic telephone advice from Brett England and once you have the forms completed you will feel much more confident at explaining what happened/when.
I don't suppose anything you tell the OR will surprise them or be something they haven't heard a hundred times before.

Hi Mst,

Most quality bankruptcy specialist firms would offer a service where they are physically present for the court date as well as the OR meeting.

In respect of your level of debt etc, I went BR for significantly more without any assets and there was no problem.

Thanks everyone,

Just a quick follow up question. If you do opt to pay a recommended firm to assist with your BR would they be present at court and with your interview with the OR?

I am quite interested in some assistance with my BR mainly because my unsecured debt spans back over 11 years and over this period my debt has been spread across vaious different creditors and consolidation loans. I would estimate that half of my 40K debt was obtained through gambling whilst the rest was just simply over spending, holidays, meals out, CDs, nights out, shopping etc etc. It fear it might be difficult for an OR to accept that is possible to have spent 20K over what I currently earn and have no assets to show for it?

Regards,
mst

I will discuss my concerns with the BR firm that contacts me. I do have quite a high disposable income but do not wish to enter an IVA as to cope with the demans of a tight budget for 5 years coupled with the risk of it failing and just never going down has lead me to seek the BR route.

I am sure there are others on here who feel that the stress and confusuion associated with debt problems eventually leads you to favour the line of least resistance. Therefore I am just going to go BR, pay the money, deal with whatever IPO I am hit with but know that if I meet that payment for 3 years I will once again have my life back. If I get made redundant within my 3 year IPO so be it, they must surely allow me moeny to live/pay my rent whilst seeking a new job. I have never been out of work since I turned 18.
