hello can anyone please help i am a discharged bankrupt and wanting to rent a home for myself and daughter who is eleven, the house we're in is going for repossesion as my ex husband refuses to pay his share, i'm on the council list but not classed as priorty what is my best solution and do the estate agents take on discharged bankrupts?

Hi

What you have been told by the Council is nonsense!!

You will be in a priority need category and as you have:

A medical condition
Children of school age

They have a duty to give you advice and assistance and they cannot prejudge your application. Neither should they be subjecting you to a B&B hotel as this goes against all good practice.

I can assure you that as a Head of Service, I would not let my staff treat you like you describe.

I am a self employed consultant and was a Director of Housing for 8 years in the 1990`s and I do know what the council should and should not be doing

Go back to them and say youi have sought advice and that they are not being as they should be.

Go to the local CAB and Shelter - they will assist you

I am happy to guide you through this too

Hi Richard, thanks for your reply, i am actually registered disabled, and been into our local council to enquire where i stand in all this, unfortunately they tell me theres nothing can be done as i haven't been issued with court procedings yet and when we are, the best they can offer is either a b&b or bedsit for both of us.....its a living nightmare to be honest i need to be close to family as they are my carers aswell and don't drive, but none of this seems to come into consideration, i understand a house cannot just be built for my needs but a b & b is unappropriate, also may i ask would there be a chance of keeping the property we're in if my solicitor issused court proceddings against my ex for non payment on the house as his name is on debt too, could he be liable (like myself) to make any sort of payments whilever our daughter is of schooling age, the house is in neg equity so selling wouldn't benefit anyone,i've enquired with some letting agents who will take on discharge bankrupts with a garantour but to also take on the benefit top up scheme are few and far between, any advice is appreciated thanks

Hi

Interested to know whay you may not be a priority...

Do you have any health issues?
I see you have a child of school age - you are likely to be in "Priority Need"
Do you have any illnesses that may cause you hardship?

Has your mortgage company started proceedings against you yet?
Some letting agents will assist you - but may ask for a guarantor

Post more detail and I will try to assist you

Hi and welcome to the forum.

When bankruptcy is on your credit file, you may find some of the rental agencies will want a guarantor. There are plenty of private landords who will quite happily rent to you.

Jane who posts on here was in a similar situation and I think she went into private rental first and then got a council house. I'm sure she'll explain if she sees your post.
