I have split up with me ex and we currently owe around £30000 in joint dabts and I owe a further £17000 in my sole name. My income is around £1700 per month with a surplus of £350 a month. I am currently on a debt management scheme which I pay £99 towards for my sole debts..I have recently been made aware that the joint debt has not been paid (the ex is refusing to pay). I am not sure if I am eligable to file bankruptcy?? Please advise as the bankruptcy fees would be hard for me to gather!! Thanks

I agree with Viki.W and getting free confidential advice may be your best bet so that everyone understands your situation.

However from the information that you have given in your posting, the joint debts are your ex's and your joint responsibilities ie. if you can't pay (because you are bankrupt, perhaps), then he will have to pay and vice versa. You are both jointly and severally liable. You can apply to make yourself bankrupt but it is likely that you would have to make a monthly contribution for 36 months towards your creditors. Don't worry, the joint creditors will still chase your ex! He will not get off scot free.

I suggest you give one of the experts a call to chat everything through as bankruptcy may be an option but there may be other options too.
