 Bankrupt last July, Northern Rock keep on at me

I went bankrupt last July, Northern Rock keep on at me for the mortgage arrears even though I have told them I have been made bankrupt, I told them to go after my ex-husband instead who ran up all the arrears and who is refusing to pay anything towards debts. He will not respond to them so they keep contacting me. I thought the house was included in the bankruptcy and they should leave me alone. I am worried after the bankruptcy ends they will still come after me for the debt.

no they are allowed to contact you until the debt becomes unsecured, You are equally entitled not to reply to them

Thank you so much I have been so worried, I have told NR time and time again I have gone bankrupt so they should not be contacting me but they do not listen. I will tell them again I want the property repossessed. Will they go after ex-husband for deficit if property is repossessed? As he refuses to answer their calls/letters they keep contacting me. I thought they had to deal with Official Receiver and not me as I am bankrupt.

However, until it's repossessed, they will keep on about the arrears, just reply to NR, informing them(if neccessary again) that you cannot pay the arrears, and simply want to return the property to them for repossession. This is typical of NR, remember they had to be bailed out by the government because they were so badly managed, by the sound of it nothing's changed!

That is exactly what would happen if the mortgage was in joint names with your ex husband.

I havent lived in property for 2 years, ex husband was going to take it over then let it out without my permission but he hasnt paid a penny to mortgage company, got receiver in to collect money but now no tenants and NR are deciding whether to repossess. I want them to repossess it, I went bankrupt and if they repossess what will happen to deficit in money as in negative equity, I thought as I am bankrupt they will leave me alone and go after ex husband for debt.

As Blackie says, we need more info about the property, by the sounds of it you're still in it, having thought that any liabilities associated with it would be claimed in bankruptcy, leaving you to live there. However, unless the house has been repossessed, then you and your ex are still liable which is why NR are still pursuing you.
The only other possibility is that if you did give up the house and signed a deed of acknowledgement, meaning that even if bankrupt the liabilities can't be claimed in bankruptcy.

Hi Cheryl.tt

I think that we need to know about the status of the property in question. If you still own the house, you will have to pay the arrears or you risk the house being repossessed. Unfortunately both your ex husband and you are jointly and severally liable for the arrears. If he won't pay, then you will have to. If the property has been repossessed, any shortfall to The Northern Rock will be included in the bankruptcy.
