Hi, I'm petitioning first thing tomorrow morning. I get JSA, so am only expecting to pay £525. I have my last 3 months bank statements, but the most recent letter I can find from the benefits agency is dated 11th April (i.e. more than a month ago). I do really get it, I'm not trying to pull a fast one, and I have a signing-on book with an appointment for tomorrow afternoon. There's no time to get a letter from the benefits agency.

WHAT WILL HAPPEN???????
Will they just take my £525 and tell me to bugger off, will they charge me the £175 (which I don't have), will they be happy with proof forwarded after tomorrow? I'm in a spin!

I read your blog over and over for weeks (Tracyjr), before and after I declared bankruptcy.

I scoured the internet and found every 'official' piece of information that I could, but reading a personal account was 'reassuring'. I know thats a lame description, but it was good to hear what you went through, the battles you fought, the pressures you went through, and the sheer fact you came out of the other side, and from what I can gather, all the better for it.

I wish I'd kept a similar blog, so that others could benefit.

Although I've kept a diary to date, all I can do is answer my personal experiences to date, even though I still dont have some answers to my questions from early on in bankruptcy, but I'm sure they'll come out in the wash.

Bankruptcy is a scary thought and if the forum can help people realise that it's not as bad as they think then that can only be a good thing.

Only when the last tree has died, the last river has been poisoned and the last fish has been caught will we realise that we cannot eat money.

Last IPA payment made on 28th June 2010 and I'm now looking forward to getting married in September 2012 - I'm proof that you can go BR and come out the other side.

Very sad indeed.
I hope you and your colleagues weren't too deeply affected, or implicated.

I would like to think in future, that most people are adequately informed of the process required by organisations such as the CAB.

I agree,seeing a judge is a last resort.
Going bankrupt is a last resort.
It shouldn't be thought of lightly.

Bankruptcy is different for everyone.
A certain amount of 'paying for ones mistakes' is inevitable.

Having said that, it is in place to let people have a 'second chance', and to encourage entrepreneurs.

let me tell you a true story and part of the reason why i started posting on boards like this to provide clear information on the reality of what happens in bankruptcy.

As many people know i used to be an examiner for the OR's office, one day we came out of a meeting to be greeted by a couple of police officers, The reason they were there is that a colleague of mine had been mentioned in a suicide note. The person in question had been in debt for a long time but had been avoiding contact by all her creditors, she thought quite wrongly that she would be sent to prison if she went to the bankruptcy court. A creditor made her bankrupt in her absence and the case was assigned to our office. Many letters were sent to her asking her to contact the office to discuss the bankruptcy which she again ignored. Eventually a public examination in court was arranged and the terms of which are that if you ignore those letters you can be arrested. not to be put in prison but simply to be brought to the court. After receiving that letter she hung herself.

So as you can see whilst it may be irrational when you know the facts of what actually happens some people really are put off from seeking the protection of bankruptcy because it involves a court appearance

It is a very serious step but I personally think it should be made as painless as possible. You will suffer repercussions for years to come as it is.

So you're saying that if you need to go bankrupt, but dont want to see a judge you wont go bankrupt??

This is a slightly odd conclusion, because the ones that would have had a problem wouldnt have been there.

Its a bit like saying that all people can climb everest because all the people that i met at the top had got there no problem.

In any event it would not be rubber stamping as an independant person appoint by the government would still have the job of looking at the applications and could still turn them down if there were irregularities

Ok, fair enough.

I think being worried and cautious about seeing a judge is a good thing, and may help to get people to see alternative to bankrutpcy.

It took me a long time to realise it was my only serious option, adnd knowing I'd see a judge and the OR made me get everything in order (paperwork etc), that I could be before filing.

I suppose the bigger the build up, the greater the relief?

You've not hit a raw nerve at all, just wanted to clarify the point in case anyone thought I had suggested it was a quick fix.

Seeing a judge wouldn't bother me but I know it is a daunting experience for a lot of people and they are terrified of the thought.

I never said that you said it was a quick fix!

Seeing a judge didnt bother me (first time I've seen one, incase you're wondering I'm used to it!)

Everyone else who saw the judge the day I did were ok with it, although aprehensive before going in.

PERSONALLY, I feel that it should stay.
'Rubber stamping', is generally never good in my opinion.

I have never said, and will never say that BR is a quick fix.

It's a last resort when all else has failed or it's the only option available to people for whatever reason.

I see no problem with people not having to see a judge.

Well, I disagree with you.

Bankruptcy is a last resort, not a quick fix.

I think the current system isnt too bad overall.

We are all entitled to our opinion.
