Hi all, it's a long time since I have been on here. It will be 6 years on Wednesday 10th September since I walked out of the court to restart my life. I have lost 5 houses and everything else I had worked for but must admit that waking up everyday with no debts is fantastic. My question is as follows: my wife (who was also declared bankrupt) owned 50% of a house with her brother that they used to let. We now live I this and have not had any correspondence from our receiver about it util 2 months ago when they offered her the option to purchase their interest. We have agreed a figure but are they still able to claim this as it will have been 6 years since BR on Wednesday.
It just seems funny that we have not heard anything for nearly 6 years and now they are writing asking for the money every other day.

Hi, we have only lived in this house for 1 year. We have been in rented until then whilst we decided on our future.
It just seemed funny that we had not heard anything for nearly 6 years then all of a sudden the tidal wave of letters started wanting us to purchase the receivers interest.

more specifically if they were living in the property at the date of the bankruptcy order. so if they moved in a day after the bankruptcy order it would not be a family home but if they moved in a day before the bankruptcy order it would be a family home

Sorry I didn't read that bit. If it wasn't the family home whilst you were bankrupt, then they don't have to deal with it within 3 years.

Nice to see you again and it will be great on Wednesday as the BR will drop off your record!

I must admit that I was under the impression that the OR kept an interest for up to three years so I've no idea whether or not they can still ask for this.

Hopefully one of the BR experts will be able to answer your query.
