My husband and I are planning on filing for BR next week and we will be handing back the keys on our property to the OR. It is a leasehold property and each year we are billed by the freeholder for ground rent, service charge and buildings insurance. We usually receive this bill at the start of the year.

My question is, if we walk away from the property, do we need to include this bill (which we expect to receive in January) on the Statement of Affairs making our Freeholder one of our creditors so that this bill is included in the BR or are we still liable to pay it to keep the buildings insurance up to date until the property is sold by the OR/mortgage company?

It would be good to formally hand back - and have the mortgage company accept the keys before the Br .

The OR doesn't want the keys but rather any equity in the property.

You should be able to include the charges up to your BR date in your BR. Put the debt in your SOA and then mention it to the OR during your interview.

Hi,

Can anyone provide any advice on this? We are due to file for BR on Wednesday and want to include this as a debt in the SOA if that is appropriate.
