we are using a bankruptcy assist company to go through bankruptcy, they are producing our documents and going to court with us, we are paying them just under £400 they told us we could do it ours elves but our situation is complicated and I hate the forms. the question is do we need them at the interview with the OR as we gave traded they told us it may be a face to face, they also told us that there was no need for them to attend the interview as it was our interview and if they were seen to influence it the OR could demand they leave the room, therefore it was a chargeable service not required,and in any case they would support us us till discharge anyway however I understand some experts do attend so are my experts correct or do I need to speak with another expert

As an examiner with the insolvency service up until July this year, I never objected to anyone having an accountant, solicitor or IP with them as long as they did not answer for their client, but they can be useful to formulate answers better.
Having previously traded, you will have to be interviewed face to face, and in particular take with you any books and records you may have plus any annual profit/loss accounts.
Do not be worried about the interview, most of the traders I interviewed had valid reasons for becoming unable to pay their creditors, most of them related to the current recession, however you cannot just say that your business failed because of the recession, you will need to qualify that statement e.g as a builder trade suffered due to lack of business through people putting off home improvements as a result of tight money supply etc.

Additionally you say WE, in your post were you a partnership?

i have attended a few hundred interviews over the years and after the Official Receivers understand the value of someone there they are usually grateful of the attendance.

The assistance party MUST NOT lead but there is nothing wrong with providing additional data, info that the client has forgotton or additional supporting evidence etc.

If the Assistance company has done a good job, provided clear collated documentation for the OR such as credit card statements, bank statements mortgage redemption etc etc etc PLUS reasons / evidence for unusual transactions then the OR is usually very grateful.

The key thing is to remember that if you have done nothing wrong there is nothing to worry about.

You can have them there for support but as the OR says, they cannot influence the interview, they cannot answer for you, IE the OR is interviewing you not them, They can be helpfull with sorting paperwork, so its down to you
