my ex partner owes the tax man £18K and may need to go bankrupt. He claims that if he goes bankrupt he will not be able to pay me any child support maintenance. He is currently a partner in a ltd company and takes home £4K a month. Will maintenance be taken into account before the other creditors or is he correct that myself and my daughter will get nothing? Currently we have a voluntary maintenance agreement of £300 a month. Is it best to contact the csa to ensure continued payment? Any advice is greatly appreciated.

Hi m.c.

If your ex went Br then he could no longer be the director of a Ltd company and may have some challenges in running a business unless he was a sole trader.

If it is an informal arrangement this can continue through Br, however if you chose to go to the CSA and have it assessed then you would have the payment securred through Br and I suspect the payment would be nearer 600 or 15%.

Is he saying this to try to reduce the current payments?
