 Hi, I have my Court date for 4th Feb!

Hi, I have my Court date for 4th Feb! What sort of questions will the Judge be asking me other than the obvious I guess - Why did I end up in this position. Also, I'll be BR 6 days after payday, should I attempt to withdraw all my salary before court day so I know I have enough to pay bills, petrol etc. How long are bank accounts frozen for and from what point are they frozen?

Hi Lady Jay, The judge asks very little, some people dont see the judge at all. The OR will usually interview you a couple of weeks later and will go through the whys and whats. The judge just usually checks that you are insolvent at the moment and that you understand the consequences.

What bank account do you have and is it overdrawn. Many people open a co-op cashminder account as they are bankrupt friendly

The meeting with the Judge should be very brief thats if you see him/her at all. Its normally two questions have you had any advice and from where and are you aware of the consequences of bankruptcy with a reminder you have to co-operate with the official Receiver to be discharged in 12 months Its quite likely the OR will shut down all your bank accounts so I would empty them before you go and open up another after the hearing with the Co-Op or a Barclays cash account, as long as they do not appear on your kist of creditors. Which court are you attending?

Thank you for your answers and info. I have a current account with Co-op that has an overdaft of £200 but I'm not overdrawn at the moment and wont be before the court date, my salary is paid into this one and I havent put it on my forms as its not OD is this alright to leave it off? I was going to call Co-op tomorrow and open a cashminder with the view to closing my current account after 4th Feb.

I'm going to the County Court in Maidstone (Kent) and when I called the Court, the helpful lady said I would definitely be seeing the Judge. She said I'll have half an hour to check over my paperwork with someone then meet the Judge, I just wanted to be prepared for any questions he/she may ask!

Hi

As has already been said, if you see the DJ at all - it will only be for a couple of minutes.

If they (the DJ) do see you and do ask any questions, it will be along the lines of are you aware of the implications of bankruptcy.

I petitioned last May and was a complex case and saw the DJ for two minutes!!
