Hello
I am a council tenant, if i file for bankruptcy can the council terminate my tenancy?

Your council tenancy should be fine as long as you keep up with the rent. Only private tenants might have a problem in this instance.

Hi

I agree with debtrider.

I do not know of any council that has an express clause within the tenancy agreement about anything detrimental about being bankrupt. I do, however, know of tenancies in the private sector where there are onerus clauses.

The whole ethos of a council tenancy is that it is "secure" and has been since the Housing Act 1980.

Provided that the rental is paid when due and that you conduct yourself in a "tenant like manner" you will be fine

I hope this assists and wish you well with your decision as to whether to peition for bankruptcy.
