Hi, We are petitioning on Friday and want to apply for a fee remission based on our annual income. Does anyone know how this works? When do we give these forms and evidence in? Do we take them with our SOA to the court and hand them to the same person at the same time? When will they be assessed - will we have to wait for the £150 to be refunded or will we not have to pay it on the day? Also, how long does the whole court process take? thanks
If you are applying for a fee remission based on gross annual income, you will have to pay the full fee on Friday - £510 each - and request a refund. You have six months in which to do this. If you request booklet EX160a from the bankruptcy clerk on Friday,it will contain details of the evidence that you have to supply, instructions on how to apply for a fee refund and the applicatioon form which you send to the court.
The court process could take anything between 1 hour and three house depending on the court.
Thanks, we already have the booklet and the form so have all the evidence ready now. We are applying under category 2 which is based on having a low annual income, not benefits, can we take the form and evidence to court and will it be assessed there and then?
