Hello, my partner has recently been made bankrupt, he lives in my property and rents his out, his bank account has been closed so therefore he is having his wages paid into my account and all his bills are coming out from this as well. He owns his own property which he rents out and the tennants pay the rent into my account as well, the offical receiver now want the tennants to pay the offical directly. Is this correct, he also wants my bank statement to check that my partner's mortgage has been paid, is this correct, the bankruptcy has nothing to do with me, these are not my debts and we are not finacially linked in anyway, why would he need to see my bank statement??

Hi

Sorry to hear about your problems.

On the property is it a Buy to Let? Is there equity in it?

The OR has the power to have the tenants pay him/her direct on BTL properties. The rent will then be divided up to your ex partners creditors and there is likeliehood of the property being sold.

I think your ex has a duty to his tenants to inform them to enable them to find an alternative place to live.

The only reason (assuming you have no interest/share in the property) that the OR is wanting to see whether the mortgage has been paid and the rent paid in up until now, to the account.

It is best (if you are not together anymore) that you separate the financial ties that you have in place.

I am sure a financial/insolvency expert will post too.

Seems to be a bit awkward for you - best to seek some independent advice

Regards, Richard

hello, the property is in negative equity and is not on a buy to let mortgage, i think the best thing for me if he has a seperate account for all his wages and bills otherwise it will get messy.... thanks for your reply

Hi again Rachel,

It does sound a bit messy - does the lender know he has let the property?

I wish you well, Richard

as far as bank accounts go the one most people in BR go for is the COOP cashminder basic bank account they are very BR friendly and the facilities with the account are very good
he should have no problem getting one of those

Don't worry or know that worrying is as effective as trying to solve an algebra equation by chewing bubble gum.(Baz Lurhman)
RevivaUK and Paul Johns helped me through it all i can't recommend them enough!!
