Please can you help me on this issue.
I was declared bankrupt in June 2009. But my ex- husband still lives in the house with a mortgage and arrears which are he has accrued and also a joint commercial mortgage which is at present also in heavy arrears. I need help to confirm if I am liable for any arrears when my bankruptcy has expired and what action can I take. As I have been advised I am i able, is this correct and can I force the sale of house and commercial mortgage.I believe my ex husband is taking profit also from the commercial mortgage as this contains flats and shops, I have not received any money as my name is on the mortgage, can I claim anything.

Hi Linda

Firstly I presume the details of the properties were listed in your statement of affairs as well as the secured mortgages, then your liability is discharged when your bankruptcy expires as you say, in June 2010 up to that point you still have a liability if your circumstances should change, ie the six balls on the lottery. The bad news is that you are not entitled to claim anything either.
