I am trying to help a friend clean his credit file up post BR.
He was declared BR in April 09 and discharged in Nov 09 and all of his creditors included in his BR still list his debts as outstanding and in default. I am compiling the letters to send out asking his creditors to correct the default dates to match his BR date, and to show the debt settled or part settled and that date to match his Discharge date.
My question relates to his CCJ. He only has one but what do we need to do regarding this as I cannot find any information on correcting CCJ info post BR.
Do we just leave it showing as active and the debt still owing as the judgement date was before his BR?
I have been given the following advice over on the Money Savings site and thought I would post here in case anyone has the same query. Courtesy of a poster called fermi:
There will be two entries for the debt on the CFS.
a) The entry in the "credit account" section. b) An entry in the "court judgement" section.
For:
a) You can get the debt marked as settled due to the BR as the sticky explains.
b) You can ask the creditor to agree to the court issuing a certificate of satisfaction, but the creditor does not have to.
The CCJ doesn't matter really. That will be gone from the record before the much worse BR order itself is. Not worth expending too much effort on.
