Council Tax
Despite having informed the Council Tax office on numerous occasions that I have become bankrupt they are continually hounding me for arrears prior to my BR and for a period on my former property after it was repossessed (something about my name still being on the deeds even though I have been evicted by the friendly folks at Morgage Express).
I am dealing directly with the head of the Council Tax department but as far as she is concerned this debt it still owed.
I have asked for a complaint form but it only gets directed back to her, which all seems pretty pointless.
They are now threatening bailiff action, which I could really do without as I should imagine that even if the Council Tax office are in the wrong they will not be interested.
Is there anyone else I can take this to so that I can both stop this action and ideally educate my council about what happens to debts in bankrupcty?

Good morning,
What you describe is quite common.
A few questions:-
Was the property included in your Bankruptcy? Were the C/Tax arrears in the BR? Are you now discharged? Have ME repossessed the property? Is it or was it empty for a period and when?
If you can answer these, I will look in more detail.
As to a complaint. She may be head of departtment - she is NOT God, so the complaint is to the Chief Executive of the Council. If that is not satisfactory, then the Local Government Ombudsman. I speak as a former head of Department on a local authority for 8 years!

The Local Government Ombudsman is at:-

However, they will only investigate after you have gone through the local authority complaints process:-
Normally it is a complaint to the head of the relevant de[partment and if she/he does not give you a satisfactory answer, then it is to the councils Chief Executive. All of this will be on the council website. I do not know which council it is so either let me know and i will look for you or have a look online yourself. It will be;-

Back to the council tax - it seems to me that if the property was empty post your BR petition before it was taken back by ME, then the period between you leaving and it being sold, (all within your period of being undischarged I seem to believe) then the Council will "exempt" the property due to a Trustee (the OR) being the "responsible person" for the property at that time. The exemption is known as "Q". The council will be fully aware of this exemption entitlement and should apply it without question.
As to the arreasr of council tax up to your BR, this will be captured within the BR so so far as you are concerned, should be "gone".

just a thought, for the arrears prior to the bankruptcy order, did they have a liability order |
