if i declared personal bankruptcy if i got divorce costs awarded to me what would happen to the money

The costs would go to paying your solicitor I would imagine?

Only my costs back possibly £2,000, i have borrowed the money from my new partner and want to pay him back with the money from my divorce but concerned if i declare bankruptcy before my divorce is finalised i will lose all the money and the reason for going bankrupt is because of a lenghtly divorce (2 yrs)

If you are bankrupt then any assets will go to the OR, including costs if the solicitor has been paid as you go along.

BTW, it is extremely unlikely that you would be awarded costs because usually in a divorce each side pays their own.

Hi Amanda

If the costs to your solicitor were unpaid, and the divorce settlement included his/her costs being paid then it may well be allowed.

If the costs have been paid by you borrowing from your new partner he is now one of your creditors, and you wouldn't usually be allowed to pay him in preference to your other creditors.
