Hi everyone,

I was made bankrupt nov 08. I am now discharged.

Can anyone help me answer the following questions as the OR are basically not telling me the full story.

1. OR have 3 years from the bankruptcy date to sell my main residence. Is this correct?

2. Can they only sell if there is equity in the property?

3. If we are still in negative equity after 3 years then what happens?

Hi you should have had form BHNOT sent to you which informs you of the 3 year rule and you should have had the booklet "what will happen to my home?" in the pack you received at the start.

1. they have 3 years to deal with your interest, this could be to sell, to place a charge or to disclaim.

2.There would be no point to sell if they were not going to get anything.

3. The property will be returned to you
