The house is solely in the maiden name of my wife as is the main mortgage, however we took a second mortgage in joint names. If I am made bancrupt can they seize the house?
Only I will be made bankrupt not my wife. The second charge is joint and several. There is equity in the house. We have lived together all the time and I have been contributing to the household. When the house was bought a letter was drafted signed and lodged with the conveyancing solicitor stating that I had no claim on the property. We got married 2 years later and now have 2 sons. The second charge was taken to pay off other debts.
