The house is solely in the maiden name of my wife as is the main mortgage, however we took a second mortgage in joint names. If I am made bancrupt can they seize the house?

Hi

Welcome to the Forum. An interesting question.

Who is going Bankrupt? Is it you or both?

What was the second charge for - is it joint and several (I assume that it is - it must be)

Is there any equity in the property?

Come back with a bit more detail and will put on my thinking cap

Richard

Also, have you lived together all the time she has owned the property, have you been contributing to the household throughout

Only I will be made bankrupt not my wife.
The second charge is joint and several.
There is equity in the house.
We have lived together all the time and I have been contributing to the household.
When the house was bought a letter was drafted signed and lodged with the conveyancing solicitor stating that I had no claim on the property. We got married 2 years later and now have 2 sons.
The second charge was taken to pay off other debts.
