Hi guys

I have been wanting to go bankrupt for about 5 and half years now I havnt made a payment for over 5 years and every time I start to get thing ready and save the money up to go bankrupt every thing goes quiet, so I put it off again.

my wife has recently been discharged from bankruptcy and is no longer in debt, it all went very straight forward with her she is on a salary she was given a nill tax code and just paid the tax to a company called moon beaver. this ran for 6 month up till the new tax year when everything went back to normal and she was given an early discharge after about 6 months.

that makes it all seem very easy, my problem is I have been self employed for the last 5 years with very little earnings, for about 4 years I was a taxi driver and then for the last 18 months I have been doing bits and bobs making websites for friends and dabbling selling stuff on eBay, as my wife's wages cover the bills I haven't really needed to make a great deal of money.

currently I earn £250 a week cash in hand for graphic design work, this wont show in my bank and i don't have a paper trail to prove my income.

I have no assets at all, I rent a house my wife has a car but i don't need one so haven't got one, I have a computer that i use to make websites and do some graphic design work on.

how will the OR deal with me I have no proof of income and haven't for the last 18 months my bank account will show a maximum of £1000 going in over the last year from payments for jobs.

I'm in £30k worth of debt, Its been sold on and on to so many different companies I've no idea who i owe the money to anymore.

So my questions are how will the or deal with me, its going to seem I'm being unwilling to help but I honestly cant provide proof of earnings.
What can I do to make it as smooth as possible and not upset the OR.

First of all, surely you should be filling in a self assesment tax form if you are receiving cash in hand

I have some one that does my books, I tell her how much i earn, but because its such a low amount I dont pay tax

Hi Asty

You can only provide the OR with what you have - fill in the forms to the best of your ability and explain the position to the OR when you talk to him/her.

If you don't have records you don't have them - its as simple as that - if you have someone who does your books they will have something you can provide to prove your earnings, but the OR will just have to accept that.

It won't seem you are being unwilling if you explain things honestly and openly - you can't give them what you haven't got.
