I am about to put in my forms for bankruptcy. I am the main wage earner, my husband is on benefits and I pay his debts out of my wages. Can I include his debts as part of my bankruptcy process. Can we have a joint bankruptcy and still only pay the one fee as he is on a state pension plus disability allowance?
He will include his own debts on his bankruptcy forms. You will then complete the income and expenditure for each of you. You obviously do not include the payments to creditors on these forms as you will no longer be paying them. If you are definately decided that BR is the right course of action for you then you should stop paying these creditors now. This will enable you to save for the fees for BR.
There are 2 fees for bankruptcy, the court fee £150 and the bakruptcy deposit £450, if you are on certain banefits you dont have to pay the court fee (you fill in an exemption form)
