I haven't been on this forum for ages but I really didn't know where else to turn to and am hoping someone with a bit of benefits knowledge will be able to help. It's a long post so apologies.
I was discharged (early) March 2009 and have an IPA although this is on hold as my partner is out of work.
I had a breakdown last year due to family bereavement and other issues from my past so my work hours were reduced to only 20 a week.
Last year I asked to go back on full time as I couldn't afford to just do 20 hours per week but because of the economic climate they reduced them again to 16 hours per week.
That suited me at first because partner was in work and I was just getting over my breakdown.
Then July this year partner lost his job again and is still out of work. I began seeking another job and found one. Great I thought, it was 24 hours per week then possibly going to 30 hours then full time.
I handed my notice in and am due to finish my current employment on the 11th November (next Thursday). I have gone into my new job the past two Fridays to get to know everything before I officially start. I haven't signed a contract yet, although I do have one.
Problem is, the new job. It's not what it appears to be or what I thought it would be.
My new boss owns a cleaning firm, three in fact. One for domestic, one for commercial and well the other.... hmmmmmmm.... I found out its part of the adult industry (I will say no more).
I thought I could cope with this but obviously I can't. Those that know me will know I had issues in my childhood and those feelings have started to rear their ugly head again and causing me to have sleepless nights and anxiety. Its far too personal for me. Plus, the office is in the womans house, she is having male "friends" round and is always talking to me about her private life etc... which is far too private!
I don't know what to do. I leave my job next week and I can't honestly work in this new job as it is going to make me ill again and I have learnt my health is far more important.
Trouble is, I can't claim any benefits to help until I get a new job can I as I have left on my own accord?! I can't stay where I am as my boss has offered my job to someone else and she is coming in today for a handover.
I apologise for the long post but I am not sure who to turn to. I need help, financial and emotional at the moment and I don't know what else to do. Please help!

Hi Maizie,
So nice to see you posting, but what a horrible situation!
I don't know what to suggest other than a trip to the CAB or a call to the benfits office to find out what you are entitiled to as it seems to me the job wasn't described correctly to you. In which case, you may be entitled to something.

Hi there - I think I may be able to help you - in 2002-4 i had a period working for the DWP overseeing appeals on benefits etc (I had reached the end of my tether in the Insolvency Service!) If you decide to leave this 'new' job and make a claim for benefits you will have to show 'Just Cause' in that you had no alternative in leaving your job (from your post - you will able to do so) a claimant has to proove that they had 'just cause' in leaving a job and that they were unable to remain, and as in your case, unable to return to the new job.
It is ok to state that, contrary to your initial thoughts the job was 'unacceptable' (state background reasons as per above re childhood) you must however have asked your new employer, whether there was an alternative role available elsewhere, if you do this and tnere is no other available role, you would have 'just cause' to leave your job, and thus be able to make a claim for JSA. It may be that your 'claim' will be referred, but all this means is that a DWP officer will ask you to supply in writing your reasons, they will then make a decision on your 'entitlement'. You have to 'show' that you did what you could ie ask for an alternative role with the new employer/ asked 'old' employer to stay.

Thanks for the replies. I can't ask the old employer as the new girl has already signed a contract. With regards to the new employer, it is only me and her running the office so no scope for employment. Is this enough or do I have to provide further evidence?

I, like you would find it difficult if not impossible, to be expected to do such a job, If as you say, you were not aware of what the job actually entailed until you had handed in your notice in the other job, you would be okay - as this gives you 'Just Cause'
