Hi, I was made bankrupt March 12th 2009 and discharged 6 months later. I have just been advised that I am to receive a tax refund of £1300. This is to do with the advertised under or over payment of tax over several years. HMRC have said I will receive the cheque within the next 14 days. Now of course my question is, will I get to keep it or with the Official Receiver take it?
If it relates to the period before you were discharge then it goes to the OR
Thanks for the information, a shame but fair enough. Will the O R cancel the cheque or will they request the funds back? I have read in other forums that as I was discharged O R may well pay no attention to it unless a IPO form (or something like that) had previously been filled out? Thanks again Jeff
Normally the payment would be sent directly to the OR and you wouldn't see any of it. When you declare BR you sign 2 forms and 1 of these (can't remember which) is agreeing that the OR can have access to your tax records and any tax rebates are paid directly to the OR.
You may be lucky as you have been discharged for a while now and receive the cheque. If you want to be 100% honest and make sure that you don't get bitten at some point in the future then you should contact the OR and advise them of the rebate.

Thanks again for the information, Yes that is what I have gleamed from other information I've read so far. I contacted the official receiver that handled my case & advised them, as you said I don't want to be bitten in the future or even spend my time worrying about it.. life gives you enough worry without creating your own:) They are going to get back to me later today as they have said it is an old case which they need to look into to though he did say there's a fair chance I will get to keep it but I'm not going to get excited about it till it's in my hand! I will post the response from him when I get it to possibly help other people on the site.
