Had a call from NR this morning, they are aware that my IVA proposal failed and wanted to know when i was going to start paying again. I informed them that i was not in a position to pay and was in court 24th June to declare BR. They started to get a bit funny and tried to tell me that i was not guaranteed to be accepted into BR and in the meantime i should continue paying in case it was rejected. My concern is not whether my BR application will be accepted it is whether i should of told NR of my intentions. Can they do anything between now and the 24th? a charge on my property for instance? I thought i was doing the right thing by telling them the truth but now i am really worried i have shot myself in the foot. Please somebody reassure me i am not the fool i think i am right now.

Hi Hammy,

Northern rock won't be able to get a charging order in time, so don't worry. In addition, there is no issue regarding being "accepted" for BR....the only possible reason the judge may decline it is if he/she feels it is not in your best interest. With a failed IVA rpoposal behind you, it is likely even the judge will consider a BR a complete "no brainer". No need to worry.
