Hi everybody

I went to BR on 2 of November 2009. Do you know when could I be discharge? It's more then one year and I didn't hear from them nothing yet.

I also wanted ask. I have got mortgage and the price of house is maybe same maybe little less then the mortgage is. Can I just give the bank keys back? Is that possible? How can I do that?

Please help, thank you

Hi Kate

The insolvency service web site is still down, normally I would recommend printing off your discharge from this page.

are you subject to an IPA or BRO ?

They did advertise a phone number to call for info but this has been withdrawn due to over use.

at the moment the OR still (i believe) has control over your title deed so it may be a good first point of reference to call them and ask the process.

Ok, so they don't send any letter that I am discharged??
They didn't take the house cause price was less then mortgage and it is joint account with my husband.
I haven't got IPA and I don't know what is BRO.
Because I want move out of the country and selling the house is long process and maybe I could sell the house for less then the mortgage so I wanted just give the house to bank back if it is possible. But I don't know how to do that.

Hi Kate,

Once you've made alternative living arrangements, send the keys back to the mortgage company recorded delivery telling them you want the house repossessed. Contact the OR and tell them what you have done and don't sign anything with the mortgage company.

If the house is jointly owned with your husband and he didn't declare bankruptcy, then he will be chased for the full amount of any shortfall, if there is any.
