I was made bankrupt in 2001, but in 2002 I inherited some money and the bankruptcy was annulled (not discharged) after all debts were cleared.

A solicitor told me at the time that I could legally answer the question 'Have you ever been bankrupt' in the negative. I never really believed this(!), but I am, sadly, going to have to go bankrupt soon and now need to know. Do I have to disclose this bankruptcy on the official forms?

cheers

Hengus.

Hi,

Not sure but I think you may have to.

One of the experts will be along to advise.

If I do, I presume this will be in 1.14 of Form 6.28, the Statement of Affairs. Doesn't seem any way to avoid it. Its a bit strange. 6.27 talks about 5 years, but 6.28 talks about 'ever'....

I guess my next, supplementary question will be, how on earth I find out the details of my bankruptcy (I know the court and the year but not the number or the date of annulment - and yes, I know I should have kept the details, but...!)?

You could try looking on the London Gazette website. If you search in the BR section you should still be able to find the details.

Only when the last tree has died, the last river has been poisoned and the last fish has been caught will we realise that we cannot eat money.

Last IPA payment made on 28th June 2010 - it's over at last!

Excellent advice...thankyou...I found details of the bankruptcy in seconds. What about the annulment though? How would I prove that? Could I contact the court?

I can't think of any other way to be honest. Hopefully if the court can't help you they will be able to point you in the right direction.

Thanks again. I have sent an email to the Official Receiver who dealt with the bankruptcy. I'll see what they say...

Hang on...that's (at least proof of the bankruptcy without proof of the annulment) exactly what I was worried about..

Seriously, I've now found proof of the annulment from the OR and the Court. Thanks for the help, guys.
